A Detailed Look at Our Terms and Health Coverage
What to Expect in Our Contract: Deposit Agreement
We understand that reserving a puppy is an exciting and important step. This tab provides an easy-to-understand overview of the Puppy Deposit Agreement, which applies to upcoming litters and puppies sold before 9 weeks of age. It highlights your responsibilities as a Buyer and the commitments we make as the Breeder. Below, you’ll find everything you need to know about pricing, policies, and guarantees, all in one place.
Purpose of the Agreement
This Deposit Agreement is designed to reserve a puppy for you until its official go-home day. The puppy is sold as a companion pet only, with a mandatory Spay/Neuter Agreement and health guarantee. It ensures that the health, care, and future of your puppy are prioritized, with guidelines for spay/neuter requirements, rehoming, and health guarantees. By signing this agreement and placing a deposit, you secure your spot for a puppy under the outlined terms.

What to Expect in Our Contract: Health Agreement
We understand that choosing a puppy is a big decision, and we want you to feel confident in the process. This tab outlines the key points of our Health Guarantee Agreement, including your responsibilities as a Buyer and the protections we provide as a Breeder. By following the steps below, you’ll ensure your puppy remains covered under our health guarantee and comply with our spay/neuter agreement. Please review carefully, and let us know if you have questions!
What is Covered Under the Health Guarantee?
Our Lifetime Genetic Health Guarantee protects your puppy against specific hereditary health issues. We work to provide healthy, well-bred puppies, and the guarantee focuses on conditions outlined by Embark Veterinary, Inc.
- Covered Conditions Include:
- Hip Dysplasia (Graded severe or higher)
- Retinal Dysplasia (causing vision impairment or blindness)
- Subaortic Stenosis (congenital heart defect resulting in death)
- Elbow Dysplasia (Graded 3 or higher)
- Sebaceous Adenitis (skin condition with covered treatment costs)
While these are the primary conditions covered, we recommend reviewing the full agreement for more details.
- Exclusions:
- Illnesses caused by environmental factors, improper care, or accidents (e.g., poor diet, trauma, chemical exposure).
- Vaccination or medication side effects, infections, stress-related illnesses, cancer, hernias, and parasites like Giardia or Coccidiosis.
- Without a necropsy, any claims for coverage related to the dog’s death will not be accepted.
How to Activate the Health Guarantee
To activate your puppy’s health guarantee, you must complete the following steps:
- Schedule a Veterinary Exam
- Take your puppy to a licensed veterinarian for a general health exam within 10 days of take-home.
- Provide proof of this exam to the Breeder to maintain your health guarantee.
- Failure to complete this exam voids the health guarantee.
- Activate Free Health Insurance
- Activate the 30-day free Trupanion health insurance policy provided on take-home day. Instructions will be shared with you.
- Activation is mandatory for the health guarantee to apply. Extended coverage beyond the trial period is optional but recommended.
- Comply with the Spay/Neuter Agreement
- The spay/neuter requirement is mandatory for all buyers, whether or not you activate the health guarantee. See details in the next section.
Spay/Neuter Agreement
This agreement ensures all puppies are companion pets and prevents unauthorized breeding.
Key Requirements:
- Timing:
- Puppies must be spayed or neutered by 18 months of age by a licensed veterinarian.
- Proof of Procedure:
- Provide proof of spay/neuter to the Breeder, including a Certificate of Spay/Neuter or signed veterinary documentation with the procedure date.
- Breeding Prohibition:
- The dog is sold as a companion pet only and cannot be used for breeding. Accidental or intentional breeding voids all health guarantees and may result in legal penalties.
Exceptions:
- If you need adjustments to the spay/neuter timing, you must receive written approval from the Breeder.
- Any deviations without prior approval void all guarantees and may lead to financial penalties.
What Happens if a Covered Condition Occurs?
If your puppy is diagnosed with a covered genetic condition, you may choose from the following options:
- Replacement Puppy: A puppy of equal or lesser value from the next available litter. Additional shipping costs may apply.
- Treatment Reimbursement: Reimbursement of treatment costs (up to the original purchase price) at a Breeder-approved veterinary clinic.
What Happens if I Can’t Care for My Puppy?
We are committed to ensuring all our dogs are well-cared for throughout their lives. If you can no longer care for your dog:
- You must return the dog to the Breeder.
- The dog may not be sold, surrendered, or rehomed without the Breeder’s involvement.
Additional Terms and Conditions
Microchip Registration
- Puppies come with a microchip pre-implanted by the Breeder. Ownership of the microchip will transfer to you 11 days after take-home, and the Breeder will handle the registration process.
Treatment Costs and Refunds
- All treatment costs must be paid by the Buyer upfront. The Breeder will reimburse qualifying expenses within 90 days, up to the purchase price of the dog.
Dispute Resolution
- Any disputes will begin with direct negotiation between the Buyer and Breeder.
- If unresolved, mediation will be required, and legal action may follow under Hillsborough County, Florida law.
Confidentiality Clause
- The terms of this agreement are proprietary and cannot be shared with third parties.
